General Terms and Conditions
Identification International, Inc., "i3", assumes no liability for damages consequent to the use of any FPCheck product or service or any material contained within the FPCheck web site, including but not limited to the FPCheck application. i3 reserves the right to change any material on this website including but not limited to: manuals, FAQs, policies, product descriptions and prices at any time without notice. The information furnished by i3 is believed to be accurate and reliable at the time of posting. However, no responsibility is assumed by i3 for its use, nor for any infringements of patents or other rights of third parties resulting from its use. Links from this site to third party web sites are provided solely as a convenience. i3 is not responsible for any of these sites or their content and does not endorse or make any representations whatsoever about them, or any information, software or other products or materials found there. Any access to third party sites is done entirely at your own risk. Both you (the "Customer") and i3 agree that the purchase of a fingerprint check ("the Service") through the use of this site is made under i3's General Terms and Conditions in effect at the time of such purchase and that i3 shall not be bound by customer’s additional or different terms. Customer's order and purchase of the Service shall constitute acceptance of these terms and conditions. These General Terms and Conditions contain the entire agreement applicable to the purchase of the Service from i3. By logging in to the FPCheck system, Customer accepts and agrees to be bound by these terms and conditions. These terms and conditions are subject to change without prior written notice at any time, in i3's sole discretion. These terms and conditions may not be altered, supplemented, or amended without the prior written consent of i3.
Online Orders
i3 sells its Service through FPCheck.com to residents of the United States only. In some cases, availability of the Service is restricted to United States citizens and/or permanent residents. All orders are subject to acceptance by i3. i3 reserves the right to reject any order for any reason including, but not limited to, the customer's inability to pay for the Service.
Prices and Payment
Prices are subject to change without notice. Unless otherwise stated, any price quotation expires when the Customer leaves the FPCheck.com website. Stenographic or clerical errors are subject to correction. All purchases are to be made in U.S. dollars. For credit card orders, Customer authorizes i3 and its designated transaction handler to charge Customer's credit card or debit card for any and all owed fees. All sums not paid when due as a result of non-sufficient funds (“NSF”) or any other reason shall be subject to the NSF fee and accrue interest daily at the lesser of a monthly rate of 1.50% or the highest rate permissible by law on the unpaid balance until paid in full. If payment is not received from Customer, i3 reserves the right to disable or cancel Customer’s use of the Service and may pursue other collection or legal remedies. Orders are entered and reviewed by i3 when they are received from Customer. However, i3 is not responsible, and will not be held liable for any processing delays or damages which may result from such delays.
Taxes
Prices do not include sales, use, service, value-added or like taxes. Customer shall pay applicable taxes, unless Customer has provided FPCheck with an appropriate exemption certificate for the delivery destination acceptable to the applicable taxing authorities.
Cancellation/Change Policy
Customer may cancel its account and use of the Service at any time upon notification to i3. Transaction-related fees, including but not limited to third party fingerprint check fees, ACH/electronic check transaction fees, credit card or debit card processing fees, and merchant account statement fees are non-refundable. Cancellation of the account must be made in writing and sent to i3 at the address or facsimile below.

Data Security
The security of your personal information is very important to us and we are committed to protecting the information we collect. While we cannot guarantee absolute security of your personal information, i3 uses firewalls, encryption, and secure communication for all personal data we collect. We also employ many different security techniques to protect personal data against loss, misuse, alteration, and unauthorized access.
Limitation of Liability
Customer understands that i3 shall not be liable to Customer for lost profits, special, punitive, consequential or incidental damages related to i3’s performance hereunder. i3 will not be liable for direct, indirect, special, incidental, cover, economic or consequential damages arising out of Customer’s use of the Service or FPCheck.com, even if advised of the possibility of such damages. Customer must notify i3 in writing within sixty (60) days from the date of occurrence of any discrepancies or errors related to i3’s performance hereunder.
Force Majeure
i3 shall not be responsible for delays, nonperformance, damages, lost profits, or other losses caused directly or indirectly by any Act of God, including without limitation, fires, earthquakes, tornadoes, or hurricanes, as well as wars, labor disputes, communication failures, legal constraints, power outages, data transmission loss, failure or interception, incorrect data transmission, or any other event outside the direct control of i3.
Governing Law
This agreement shall be governed by and construed in all respects with the laws of the Commonwealth of Virginia. Any claim arising out of or relating to this agreement or FPCheck.com shall be settled in Montgomery County, Virginia.
